Criteria for Design Registration
- Design must be new or original
- Must appeal solely to the eye
- Should not be previously published anywhere
- Must be distinguishable from known designs
- Should not relate to technical or functional features
Prohibited Designs
- Designs that are not new or original
- Designs disclosed publicly before filing
- Designs that are not significantly distinguishable
- Designs containing obscene or scandalous matter

Filing Requirements
- Application on prescribed Form with statutory fees
- Name and address of applicant with legal status
- Name and classification of the article (Locarno Classification)
- Representations (drawings or photographs of all views)
- Statement of novelty and disclaimer (if applicable)
- Color depiction where color forms the essence of design
Design applications are examined by the Design Office at Kolkata. Upon successful removal of objections, the registration certificate is issued. Registration is valid for 10 years and may be extended by 5 additional years.
